1. Acceptance of Terms
By accessing or using the HabTrak mobile application (“Service,” “App”), you agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. These Terms form a binding agreement between you (“you,” “user”) and HabTrak (“HabTrak,” “we,” “us,” or “our”).
If you do not agree with these Terms, you may not access or use the Service.
2. Description of Service
HabTrak is a habit, mood, and journaling application designed to help users track routines, personal growth, and well-being. Features may include:
Habit creation and completion tracking
Mood and reflection logging
Streak tracking and analytics
HabTrak is for informational and personal development purposes only. It does not provide medical, psychological, or therapeutic advice.
3. User Obligations and Accounts
A. Account Information
When you create an account, you agree to provide accurate, complete, and current information. You are responsible for:
Maintaining the confidentiality of your password;
Restricting access to your account; and
All activities under your account.
You may delete your account at any time through in-app settings or by contacting habtrakai@gmail.com

B. Prohibited Uses
You agree not to use the Service:
In violation of any local, state, national, or international law.
To exploit, harm, or attempt to exploit or harm minors.
To transmit unsolicited advertising, spam, or malware.
To interfere with or disrupt the Service or servers.
To reverse-engineer or modify any portion of the App.
4. User-Generated Content
A. Your Content
You retain full ownership of your personal data, including habits, logs, moods, and journal entries (“User Content”).
By using the Service, you grant HabTrak a limited, non-exclusive, worldwide license to process, store, and display your User Content solely to provide and improve the Service.
B. Responsibility for Content
You are solely responsible for your User Content.
HabTrak is not responsible for any content you or other users post, store, or transmit through the Service.
5. Privacy and Data Handling
A. Data Collected
We process personal information such as:
Account identifiers (e.g., email or user ID)
Habit and mood tracking entries
Device and app usage data
All data is stored securely using Google Firebase.
B. Data Location and Security
Data is stored on Firebase servers located in the United States or other regions selected by Google.
While we use industry-standard encryption and security, no system is 100% secure, and you use the Service at your own risk.
C. Age Restriction
You must be at least 13 years old (or the minimum age required in your jurisdiction) to use HabTrak.
If you are under 18, you may only use the Service with parental or guardian consent.
We reserve the right to remove accounts used by minors without proper consent.
D. Sensitive Data
Because HabTrak involves tracking habits and moods, you acknowledge that you are voluntarily entering personal data that may relate to your well-being.
You agree that HabTrak is not responsible for any interpretations, conclusions, or consequences you or others draw from your logged data.
6. Intellectual Property
The Service and its design, code, graphics, and logos are the exclusive property of HabTrak or its licensors.
You may not copy, modify, distribute, or create derivative works based on any part of the Service without prior written consent.
7. Monetization Policy (Currently Free)
HabTrak is currently free to use.
We reserve the right to introduce premium features, subscriptions, or other fees in the future. Users will receive reasonable advance notice before any such change takes effect.
8. Termination
We may suspend or terminate your account at any time, without prior notice, for conduct that violates these Terms or that we deem harmful to other users or to the integrity of the Service.
Upon termination, your right to use the Service immediately ceases, and your stored data may be deleted in accordance with our Privacy Policy.
9. Disclaimers
HabTrak is provided on an “as is” and “as available” basis.
We make no warranties, express or implied, regarding the reliability, availability, accuracy, or suitability of the Service for any purpose.
HabTrak does not provide health, medical, or psychological advice. The information generated by the Service is for general informational purposes only.
10. Limitation of Liability
To the maximum extent permitted by law, HabTrak and its developers, affiliates, or licensors are not liable for:
Any indirect, incidental, consequential, or punitive damages;
Loss of data, profits, or goodwill; or
Any unauthorized access or alteration of your transmissions or data.
Your sole remedy for dissatisfaction with the Service is to discontinue use.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the State of Washington, United States, without regard to conflict of law principles.
Any disputes shall be resolved in the state or federal courts of King County, Washington.
12. Changes to Terms
We may revise these Terms from time to time.
We will post the updated version in the App or on our website with a new “Last Updated” date.
Continued use of the Service after any change constitutes acceptance of the new Terms.
